GoMyid End User License Agreement (EULA)
This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User” or “Customer”) and DeskGate LLC (“DeskGate”), governing the installation and use of the GoMyid Remote Desktop Platform, including its software components, agents, modules, documentation, and any future updates (“Software” or “Product”).
By installing, downloading, or using the GoMyid Software, you agree to be bound by all terms of this EULA. If you do not agree, you must immediately discontinue use and delete all copies of the Software.
1. License Grant
DeskGate grants you a non-exclusive, non-transferable license to install and use the GoMyid Software for the duration of your subscription or perpetual license, depending on your purchase type. This license permits use of the Software solely for legitimate business purposes, including secure remote access, remote support, and internal IT operations.
GoMyid accounts and access credentials must be used by individually authorized personnel (“Named Users”). Credentials may not be shared under any circumstances. Additional users or concurrent sessions may require additional licensing.
2. Support Services
DeskGate may provide support through email, online channels, updates, patches, or improvements made available to active customers. Support coverage depends on your subscription plan or maintenance agreement.
3. Beta Versions
DeskGate may offer optional beta features or preview releases. Beta features are provided “AS IS,” without warranties, and may be modified or removed at any time. You may voluntarily submit feedback, which DeskGate may use without restriction or obligation.
4. Restrictions
You agree not to:
- Modify, reverse engineer, disassemble, or attempt to obtain source code, except where permitted by law
- Circumvent licensing limits or security protections
- Use the Software for unlawful, unauthorized, or non-consensual monitoring
- Rent, lease, sublicense, or redistribute the Software without written approval
GoMyid may not be used for surveillance, espionage, or accessing devices without user permission.
5. Intellectual Property
The Software is licensed, not sold. DeskGate retains all ownership rights, trademarks, copyrights, and intellectual property associated with the Product. No rights are transferred except those explicitly granted in this EULA.
6. Data Processing & Privacy
DeskGate processes personal or technical data only as required to deliver secure remote access functionality, licensing, updates, support, and service integrity. DeskGate adheres to applicable data protection laws and does not use personal data for advertising without consent.
Non-personal technical data may be collected automatically to ensure product performance and security. For details, refer to the GoMyid Privacy Policy.
7. Updates & License Validation
The Software may automatically communicate with DeskGate servers to verify license validity, apply security updates, or retrieve configuration data. Certain updates may be required to maintain security and product functionality.
Some versions may contain technological protection measures (TPM), such as license keys or activation services, to prevent unauthorized use.
8. Termination
Either party may terminate this Agreement if the other breaches its obligations. Upon termination, you must cease using the Software and delete or return all copies. Sections relating to intellectual property, warranty, liability, and confidentiality remain in effect after termination.
9. Export Controls
You agree to comply with applicable export laws and restrictions. You may not export or use the Software in prohibited regions or with prohibited entities.
10. Warranty
For commercial customers, DeskGate warrants that the Software will function substantially as described for the duration of the warranty period. Private or trial users receive the Software “AS IS,” with no warranties.
DeskGate does not guarantee uninterrupted or error-free operation. The Software may not be compatible with all environments, hardware, or third-party systems.
11. Limitation of Liability
Except where prohibited by law, DeskGate is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business. Liability for direct damages is limited to the amount paid for the Software.
12. Indemnification
You agree to indemnify DeskGate against claims arising from misuse of the Software, breach of this Agreement, or violation of applicable laws.
13. Entire Agreement
This EULA constitutes the complete agreement between you and DeskGate regarding the Software and supersedes all prior agreements or communications.
14. Governing Law
This Agreement is governed by the laws of USA. Any disputes shall be resolved in the courts of WY, USA.
15. U.S. Government Notice
The Software is classified as commercial computer software. Use, reproduction, or disclosure by U.S. government entities is subject to the restrictions in this EULA.
16. Miscellaneous
- If any provision is found unenforceable, the remaining provisions remain in effect.
- No third party has rights under this Agreement.
- Transfer or assignment requires DeskGate’s written approval.
